When Singapore Law Meets Indian Jurisdiction

Singapore is India's most significant arbitration partner — post-BALCO (2012), it is the leading foreign seat for India-related international commercial arbitrations. Singapore-seated awards are enforceable in India under Part II of the Arbitration and Conciliation Act, 1996 as New York Convention awards. Beyond arbitration, Singapore-based businesses, law firms, and individuals regularly encounter Indian jurisdiction — in corporate structuring, family matters, and succession. Where Indian Law Becomes Relevant

Singapore-Seated Arbitration and Indian Enforcement
Singapore is a leading seat for India-related international commercial arbitrations, particularly after BALCO (2012). A Singapore-seated award is a foreign award under Part II of the Arbitration and Conciliation Act, 1996. Singapore is a New York Convention country and is notified for Section 44A CPC purposes. Enforcement in India requires proceedings under Sections 47 and 48 — grounds for refusal are narrow.

Singapore Divorce and Indian Recognition
The Women's Charter (Singapore) Cap 353 requires three to four years of separation for divorce on irretrievable breakdown. This ground does not exist under HMA. A Singapore divorce on this ground will not be recognised by Indian courts for a Hindu couple under the Y. Narasimha Rao test.

NRI Property and Succession
Singapore probate does not extend to Indian assets. Indian succession certificates and probate orders are required from Indian courts regardless of where the applicant is located.

Indian Company with Singapore Holding Structure
A common startup structure: Indian operating company with a Singapore holding company. FEMA compliance — specifically the Overseas Direct Investment framework — governs this. RBI approval is required in certain configurations. Tax implications under the India-Singapore DTAA are significant.

FEMA and Repatriation
Indian professionals in Singapore maintaining NRE/NRO accounts and repatriating savings must comply with FEMA. The Liberalised Remittance Scheme governs outward remittances — relevant if the individual returns to India.

Child Custody — Singapore Order, Child in India
India is not a Hague Convention signatory. A Singapore Family Court custody order is not directly enforceable in India. Indian courts conduct an independent welfare inquiry.
