Overview
When UAE Meets Indian Jurisdiction

The UAE and India are deeply connected — by trade, by diaspora, by arbitration, and by family. A UAE-based business enforcing an Indian judgment, a foreign lawyer instructing Indian counsel on a matrimonial dispute with an Indian spouse, an Indian professional managing property back home — the touchpoints are numerous and the Indian law framework governing each of them is specific. This page covers the Indian law dimension of the most common matters that arise from a UAE connection.

Where Indian Law Becomes Relevant

Matrimonial Disputes
UAE divorce under Federal Decree-Law No. 41/2022 is fast and no-fault for non-Muslims. Indian courts will not recognise a UAE civil no-fault divorce for a Hindu couple under Y. Narasimha Rao v. Y. Venkata Lakshmi (1991) 3 SCC 451. The spouse in India remains legally married. Any remarriage in India after a UAE civil divorce — without a recognised Indian decree — is bigamous under Section 82 BNS 2023.

NRI Property Disputes
Property occupied, encroached upon, or transferred fraudulently while the owner is in UAE. Adverse possession claims, illegal occupation, and Power of Attorney misuse are the most common patterns. Indian courts are the only forum for these disputes.

FIR Filed in India
An FIR filed in India does not pause because the accused is in UAE. Non-bailable warrants and Look Out Circulars operate independently of where the accused is living. Anticipatory bail applications under Section 482 BNSS 2023 must be filed in India.

FEMA and Repatriation
Sending money from UAE to India, repatriating property sale proceeds, and maintaining NRE/NRO accounts have FEMA compliance requirements. Violations attract civil penalties and, in serious cases, criminal prosecution under PMLA.

Succession and Inheritance
Death of a family member in India while the heir is in UAE. Succession certificates, probate, and Letters of Administration are obtained from Indian courts regardless of where the applicant is located.

Enforcement of UAE Decrees in India
UAE is a reciprocating territory under Section 44A CPC since 17 January 2020. Money decrees from UAE superior courts can be directly executed in Indian District Courts. Status decrees — divorce — require separate recognition under Section 13 CPC and the Narasimha Rao test.
